Terms of Service

Welcome to Breatheasy. These terms are the agreement between you and Casefemme LLC ("we", "us") for using the Breatheasy app and services. Please read them, especially section 2, which explains what Breatheasy is and isn't.

By creating an account or using Breatheasy, you agree to these terms and to our Privacy Policy.

1. Who can use Breatheasy

You must be at least [16] years old to use Breatheasy, and at least 18 to chat with Luma. If you're under the age of majority where you live, you need a parent or guardian's permission.

2. Breatheasy is not medical care or an emergency service

Breatheasy offers self-help tools and general information. It is not a medical device, does not diagnose or treat any condition, and is not a replacement for a doctor, therapist or other professional.

• The lessons, exercises, games and anxiety check are for general wellbeing and education. The anxiety check (GAD-7) helps you track how you're doing; it is not a diagnosis.
• Luma is an AI, not a person or a therapist. Its replies are generated automatically, can be wrong or unsuitable, and should not be relied on for medical, legal or other professional decisions.
• Breatheasy is not a crisis service and does not monitor what you write. If you are in danger, thinking about harming yourself, or someone else is at risk, call your local emergency number or a crisis line straight away. Crisis numbers are in the app under Crisis help.
• If you have chest pain, fainting or symptoms you haven't had before, see a doctor to rule out other causes.

3. Your account

• Give accurate information and keep your password safe. You're responsible for what happens under your account.
• Tell us at hello@usebreatheasy.com if you think someone else has accessed it.
• You can delete your account at any time in Settings.

4. Using Breatheasy fairly

Please don't:

• break the law or use Breatheasy to harm, harass or deceive anyone;
• try to get Luma to produce harmful, illegal or abusive content;
• try to break, overload, reverse-engineer or get around the security or limits of the app (including Luma's daily message limit);
• copy, resell or build a competing product from Breatheasy's content;
• use automated tools to access the service.

We may limit, suspend or close accounts that break these rules or put others at risk.

5. Free trial and subscriptions

Some features may require a subscription. [Reviewer: complete once pricing is set.] In summary:

• New members can try premium features free for 3 days. The trial does not turn into a paid subscription automatically; you'll only pay if you choose to subscribe.
• Subscriptions are sold and billed through the Apple App Store or Google Play, under their terms. Prices are shown before you buy.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can cancel in your App Store or Google Play account settings.
• Refunds are handled by Apple or Google under their policies, except where the law gives you other rights.

6. Your content

What you write in Breatheasy (your journal, notes and messages) belongs to you. You give us permission to store, process and display it only so we can provide the service to you, as described in our Privacy Policy. We don't claim any ownership of it.

7. Our content

Breatheasy, including Luma, the lessons, illustrations, recordings and software, belongs to us or our licensors. We give you a personal, non-transferable, non-exclusive licence to use the app for your own non-commercial use, as long as you follow these terms.

8. Changes and availability

We're always improving Breatheasy, so features may change, and we may occasionally be unavailable for maintenance. We'll try to give notice of significant changes. If we change these terms in a way that matters, we'll tell you in the app before the change takes effect.

9. Ending your use

You can stop using Breatheasy and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we stop providing the service, in which case we'll give you reasonable notice where we can.

10. Disclaimers

Breatheasy is provided "as is" and "as available". To the fullest extent the law allows, we don't promise that it will be uninterrupted, error-free or that it will achieve any particular result for your health. Nothing in these terms limits rights you have under consumer law that can't be excluded.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect or consequential losses, or for any loss arising from relying on Luma or other content instead of professional or emergency help. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and [amount]. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

12. Governing law and disputes

These terms are governed by the laws of the State of Ohio, United States. Disputes will be dealt with by the state or federal courts located in Ohio, unless the law of the country where you live gives you the right to bring a claim there. 13. Apple App Store

If you downloaded Breatheasy from the Apple App Store:

• These terms are between you and us, not Apple. Apple is not responsible for Breatheasy or its content.
• Apple has no obligation to provide maintenance or support for Breatheasy.
• If Breatheasy fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the extent the law allows, Apple has no other warranty obligation.
• Apple is not responsible for any claims about Breatheasy, including product liability, legal or regulatory claims, consumer protection claims or intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You confirm you are not in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.
